I think no. The partition that is marked as "active" is probably already in use
by some other OS. If i have FreeBSD installed on the 3rd primary partition
which is marked as "active", ROS installer should not ruin that installation.

It should not refuse (I have ReactOS and XP installed on the 1st primary
partition), but warn the user.

That is not good.
