The APL was picked so they could keep thier DirectX code from going in
to WINE while still being Qusi-OpenSource. Also they have licensed the
SafeDisk copy protection driver and they cannot release it under a Free
Software licesen.

I will email Transgamings CEO/CTO Gavriel State. Jason and I met him at
Wineconf and I have had a few emails with him over the past year or so.
